BY BIDDING, YOU ARE AGREEING TO THESE TERMS AND CONDITIONS
- Buyer’s Premium:
- 10% with a $1000 cap per item for cash, approved check, and wire transfers
- 14% for credit card payments
- NC Sales Tax is charged on all personal property that has no title -- unless a Tax Exemption Certificate is on file
- Valid Credit Card is required for bidding approval
- Payment Options: Approved check, wire transfer / ACH, cash, or credit card
- All purchases must be paid in full on auction day or by 5pm the following Monday
- All items sold as is-where is with all faults and with no guarantees or warranties of any type, expressed or implied, as to the merchantability or fitness for a particular use or purpose - PLEASE INSPECT PRIOR TO BIDDING OR ASK QUESTIONS AS NO REFUNDS GIVEN!
- Descriptions of the items are believed to be correct but are not guaranteed. It is the Buyer's responsibility to conduct any inspections prior to the auction. Pictures and descriptions may be updated throughout the process due to giving a better understanding of the item being sold.
- All due diligence periods end the date the auction is scheduled to end and prior to the end of the auction.
- Ultimately, it is the Buyer's responsibility to inspect all aspects of the items before placing a bid. No sale shall be invalidated by the Buyer as a result of he/she not conducting their own inspection prior to placing a bid or doing due diligence. It is automatically acknowledged by placing a bid that you have personally inspected the property, hired an agent to inspect the property, or waived your right to inspect the property.
- SOFT CLOSE: In the last 2 minutes, that item will extend 2 minutes until all bidding has ceased. Be aware, a lot of bidding happens in the last few hours and closing will be fast, so if you cannot be in front of your computer at conclusion of auction, use the Max Bid feature, and the computer will handle your bidding and try and buy at the cheapest price for you.
- Auctioneer is acting only as the seller's agent.
- Winning Bidder Notification: If you are the winning bidder you will be notified with an invoice via email within 12 hours of the close of the auction.
- Charge backs: Bidder agrees that under no circumstances will he or she initiate a charge-back.
- Server & Software Technical Issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, the Auctioneer reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the Auctioneer nor the online bidding software and service provider shall be held responsible for a missed bid or the failure of the software to function properly for any reason.
- The Auctioneer reserves the right to cancel, suspend, extend or reschedule an individual item or auction event. The auctioneer reserves the right to make changes to the auction closing times or inspection or removal times.
- Email notifications will be sent to registered bidders with updated information as deemed necessary by the Auctioneer.
- Any item not picked up at stated pickup time will be forfeited with no notice to Buyer unless arrangements have been made in advance with the auctioneer prior to end of pickup time.
- No refunds or charge backs will be granted due to a lack of removal during the designated times.
- No labor, equipment, tools or supplies needed to package or remove purchases will be provided by the auctioneer. Please bring enough tools and labor.
- Any damage caused by a purchaser or other party during the inspection or removal periods must be made good by purchaser or party causing the damages.
Shipping Instructions: Buyer is responsible for all shipping costs and for all shipping arrangements.
Preview Date & Times: Friday 1 week prior to sale 9am until sale starts on sale date. Call before you come to make sure the item you are interested in is in our yard.
Offsite items sold in our auction are available for preview by appointment only.
Pick-up Dates & Times:
- For items located in our yard located at 763 Old Dam Rd, Liberty, NC 27298
- Pick up begins on the day of sale until 5pm thru Friday the week following sale from 8am – 5pm EST Monday – Friday
- For items located off-site
- Pick up is by appointment after payment has been received
Special Terms
- The highest bidder for each lot shall be the Purchaser; in the event of any dispute the Auctioneer shall have absolute discretion either to settle such dispute or to re-offer the lot for sale.
- Once an item has been declared sold to me, I cannot retract my bid and I will be required to carry through with the purchase.
- I agree that the Seller, any lien holder, or Auctioneer, either personally, through the Auctioneer, or through any other person, shall have the right to bid on behalf of the seller, or on their own behalf.
- Purchases become my responsibility and I assume all risk of loss or damage immediately upon declaration of “SOLD” by the Auctioneer.
- It shall be my responsibility to insure my purchases immediately.
- The Auctioneer shall not be responsible for any loss or damage to any lot.
- I agree that I will pay in full with cash, valid check, or certified funds within the time announced or posted at the auction site. If I pay by wire transfer, my purchase will be released to me upon confirmation of the wire transfer. If I pay by company or personal check, I understand that ownership transfers upon declaration of “SOLD” by the Auctioneer, but I will not be permitted to remove my purchase until the funds are verified paid or I have approval in writing from the Auctioneer.
- Any check returned for insufficient funds shall incur a service fee of $35.00, as well as result in the breach of the terms of this contract for failure to make payment as required hereby, in which case Auctioneer shall have all rights and remedies provided herein.
- If for any reason Auctioneer is unable to deliver my purchase to me, or deliver such purchases free and clear of liens,
- I agree that Auctioneer may terminate the purchase agreement, in which case the Auctioneer’s only liability shall be the return of any monies actually paid by me.
- All my purchases shall be removed from the auction site without damaging any property within 10 business days of the purchase. All costs, liability, damage, responsibility and risk of such removal shall be borne solely by me and, in every case, I will use prudence and care in such removal and I will not hold or attempt to hold Auctioneer responsible for any losses, expenses, damages, liability, claims or causes of action incurred by me or any other party in connection with or in relation to such removal.
- If, for any reason, I fail to remove any of my purchases within the time specified, the Auctioneer shall have the right, but not the obligation, in its sole discretion, to resell, remove and store, or discard such purchased item(s) at my sole risk and expense, without waiving any rights that Auctioneer or seller may have against me.
- I shall be liable for all storage charges and damages incurred by the Auctioneer because of my failure to remove my purchases.
- In addition, I acknowledge, understand and agree that the Auctioneer will assess storage charges for any items not removed within 10 business days of the purchase at a daily rate of $40.00 per item per day, and that the Auctioneer has the option to sell my purchase at auction, with proceeds payable to the original buyer less all applicable storage fees and less a 30% consignment commission.
- I agree that such actions by the Auctioneer are fair and reasonable, and I agree to pay any fees assessed in full immediately after such charges are assessed.
- If I fail to complete the purchase of any item pursuant to these terms and conditions, any money deposited in partial payment shall be first applied against Auctioneer's damages, including storage charges, before payment of the purchase price. All items not purchased will be resold by public or private sale without further notice, at my risk and expense. In that event, I will be held responsible for any deficit between my successful bid and the price for which the item is resold and charges arising from such resale and will be permanently banned from bidding in future auctions.
- I agree to indemnify and hold Auctioneer harmless from all loss, expense, and other damage (including reasonable attorney's fees), directly or indirectly sustained by the Auctioneer or other Seller, arising from or related to my or my Agent's failure to comply with these terms of bidding and sale or other breach of the terms of this Agreement. I shall not be entitled to any portion of the amount received by Auctioneer in the event of a resale in which an item is sold for more than my successful bid.
- The Auctioneer has described the Lots in the catalog to the best of their ability.
- The Auctioneer takes no liability whatsoever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, hours, age, condition or quality of any Lot and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact.
- The Auctioneer provides no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot.
- Auctioneer accepts no liability for any purchase made by a Buyer in reliance upon them.
- The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth.
