AUCTION TERMS, CONDITIONS & CONTRACT

PLEASE READ ALL TERMS AND CONDITIONS BEFORE BIDDING. BY BIDDING, YOU ARE AGREEING TO THESE TERMS AND CONDITIONS

  1. Each bidder must pre-register, sign the bidder contract, and have a Buyer Number to participate in the auction; live or online. The Buyer expressly agrees to adhere to the following Terms and Conditions:.  
  2. Spanish Goats, LLC and the Auctioneer reserves the right to reject any and all bids.  If a dispute arises between two or more bidders, the Auctioneer may immediately put the lot up for sale again and resell to the highest bidder. The decision of the Spanish Goats, LLC and the Auctioneer shall be final and absolute. 
  3. The Buyer is responsible for all arrangements and regulatory requirements with respect to the transportation of the livestock.  All livestock must be picked up by 12:00 noon on Sunday, October 6, 2024, without exception. Spanish Goats, LLC is not responsible for arranging or transporting purchased livestock.
  4. Each seller has the right to put a minimum bid on their animals. This is determined solely by the seller, and it is the seller’s right to “NO SELL” their livestock if the minimum is not met. 
  5. Spanish Goats, LLC does not guarantee females to be open, exposed or bred. It is the responsibility of the seller to provide blood tested proven bred documents for announcement, and to disclose in the catalog if the female has been exposed to a breeding age male. There is no guarantee on behalf of the Seller, Spanish Goats, LLC or the Auctioneer that the females will carry to term and produce live offspring.
  6. The Spanish Goats, LLC, Auctioneer, and the Seller offer these goats in good faith. The seller has expressed in writing that the goats being offered are fit for sale and production. The buyer is purchasing these goats at their own risk and in good faith.
  7. All animals that are presented in the Auction ring are verified Spanish and DNA Registered by the Spanish Goat Registry. Paperwork will be transferred into buyers name at a cost of $5 per certificate and an additional $10 for mailing hard copies. It is the responsibility of the buyer to initiate transfer documents by filling out each transfer document including in the purchase packet, and mailing them to the Registrar along with payment.
  8. All animals have been inspected by the animal’s state of origin Veterinarian. Additionally, all animals that enter the ring have been subject to an onsite inspection October 4, 2024. The Spanish Goats, LLC, Auctioneer, and Seller do not guarantee the health or fitness of any goat that is being presented at the Auction. The buyer is purchasing goats at their own risk.
  9. The Seller will furnish any health certificates required for the state of origin and Federal Law.  If additional health certificates, documentation or tests are required for shipment to the Buyer’s destination, it shall be at the Buyer’s request and expense.  
  10. Spanish Goats, LLC will accept cash or credit card payments. Checks are accepted with a current and valid driver's license at the discretion of the Cashier. Credit card payments will incur an additional fee of 3% made payable to the Auctioneer.
  11. Every effort has been made to assure the correctness of the catalog, but all announcements from the auction ring shall take precedence over printed material and any information that is published or given verbally prior to the auction.
  12. No goat will leave the auction barn until after the auction is over, and all fees and paperwork are complete.
  13. Spanish Goats, LLC and Eagle Auction and Realty reserves the right to sign the Bidder Contract on behalf of all Buyers and Sellers with written consent.
  14. Buyers: If you have the highest bid, you are obligated to complete the transaction. Bids are not retractable.
  15. It is the buyer's responsibility to ensure that their internet connection and computer are working properly. 
  16. Submission of a bid is a binding offer to purchase livestock, consignment or lot/draft.
  17. A bid is valid until livestock, consignment or lot/draft is sold or auction closes. Submission of a higher bid by another party does not withdraw previous bids.
  18. We are both buyer and seller friendly. Satisfaction of both parties is our measure of success.

  20. No Warranties. We provide our service "as is" and without any warranty or condition, express or implied. To the maximum extent permitted by applicable law, we specifically disclaim the implied warranties of title, merchantability and fitness for particular purposes. All warranties expressed or implied are between Buyer and Seller.
  21. Limit of Liability. In no event shall we be liable for lost profits or any special, incidental or consequential damages however arising, including negligence, arising out of or in connection with a sale made through this website.
  22. Live Buyer’s Premium: 5%

  24. Valid Credit Card required for bidding approval Payment Options: Visa, MasterCard, Discover, American Express and Cash that can be paid on-site at pickup!
  25. Ultimately, it is the Buyer's responsibility to inspect all aspects of the items before placing a bid. No sale shall be invalidated by the Buyer as a result of he/she not conducting their own inspection prior to placing a bid or doing due diligence. It is automatically acknowledged by placing a bid that you have personally inspected the property, hired an agent to inspect the property, or waived your right to inspect the property.
  26. Auctioneer is acting only as the seller's agent.
  27. Winning Bidder Notification: If you are the winning bidder you will be notified with an invoice via email within 1 hours of the close of the auction.
  28. Charge backs: Bidder agrees that under no circumstances will he or she initiate a charge-back.
  29. Server & Software Technical Issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, the Auctioneer reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the Auctioneer nor the online bidding software and service provider shall be held responsible for a missed bid or the failure of the software to function properly for any reason.
  30. The Auctioneer reserves the right to cancel, suspend, extend or reschedule an individual item or auction event. The auctioneer reserves the right to make changes to the auction closing times or inspection or removal times.
  31. Email notifications will be sent to registered bidders with updated information as deemed necessary by the Auctioneer.
  32. Any item not picked up at stated pickup time will be forfeited with no notice to Buyer unless arrangements have been made in advance with the auctioneer prior to end of pickup time.
  33. No refunds or charge backs will be granted due to a lack of removal during the designated times. 
  34. Any damage caused by a purchaser or other party during the inspection or removal periods must be made good by purchaser or party causing the damages.
